Terms & Conditions for Image Usage and Copyright Compliance 

1. Image Sourcing and Usage Policy

Client-Provided Images: Clients are responsible for providing images that they own or have obtained the necessary rights to use. By supplying images to us, clients confirm that they hold the appropriate licenses or ownership rights.

Stock Images: We recommend using licensed stock images to avoid copyright issues. If clients choose not to purchase these images, they assume full responsibility for any copyright claims that may arise.

Use of Online Images: At the client’s request, we may use images sourced from the internet, including Google Images. Clients acknowledge that such images may not be licensed for commercial use and can result in copyright claims. The agency is not liable for any legal actions stemming from the use of these images.​

2. Approval and Consent

Client Approval: All images used in the project will be reviewed and approved by the client during the development process. Once approved, the client cannot hold the agency liable for any subsequent copyright issues.

Verbal and Written Consent: By approving the use of any images, whether verbally or through written communication, the client agrees to assume responsibility for the legal status of those images.

3. Liability and Indemnification

Client Responsibility: The client agrees to indemnify and hold the agency harmless from any legal claims, damages, or expenses that arise from the use of images provided or approved by the client.

No Warranty on Images: The agency does not provide any warranty regarding the copyright status of images supplied or requested by the client.

4. Copyright Violation Consequences

Client Assumption of RiskClients assume full responsibility for the legal risks associated with using any non-licensed or improperly sourced images. The agency will not be held liable for any copyright violations that result from the client’s choices.

Financial Responsibility: Clients agree to cover any legal fees, fines, or other costs that arise from copyright disputes related to images used in their projects.

5. Image Acquisition Process

Paid Image Recommendation: We strongly recommend using paid, licensed images to ensure full legal compliance. If the client declines to purchase these images, they acknowledge the potential risks involved.

Image Source Documentation: We maintain records of the sources of images used in projects. However, clients are advised to keep their own records of image approvals and sources for their reference.

6. Record Keeping

Client Communication: While we aim to document client approvals and communications, clients are encouraged to retain their own records related to image use for their projects.

Documentation Period: We may not retain records of client approvals and image sources beyond 3 months  after Website project completion & 1 month after monthly Social Media Management work.
