Creative Design Services Terms and Conditions
​​​1. Service Scope

Design Deliverables: Our creative design services include, but are not limited to, logo design, branding materials, brochures, advertisements, social media graphics, website design elements, and other digital or print design projects as specified in the project agreement.
Project Brief: Clients are required to provide a detailed project brief, including objectives, brand guidelines, and any specific preferences. Any additional requests after the project has started may incur extra charges.

2. Design Process
​
Initial Concepts: The agency will present 2 initial design concepts based on the client’s brief. The client is entitled to 2 rounds of revisions on the chosen concept.
Revisions: Any revisions beyond the agreed number will be charged at Rs.5000 + GST for every additional design. Major changes that differ from the original brief may also incur additional costs.
Approval: The client is responsible for reviewing and approving all design work. Once a design is approved, any further changes will be treated as a new project and billed accordingly.

3. Ownership and Intellectual Property

Design Ownership: The client gains full ownership of the final design files upon final payment. The agency retains ownership of all concepts and designs that are not selected.
Usage Rights: The client can use the final design in all agreed-upon formats and platforms. The agency retains the right to showcase the work in its portfolio and marketing materials unless otherwise agreed in writing.
Fonts and Stock Images: Any fonts, stock images, or third-party assets used in the design are subject to their respective licenses. The client is responsible for any additional costs associated with licensing these assets for commercial use.

4. Payment Terms

Project Fees: A non-refundable deposit of 50% of the project cost is required to begin work on the project. The remaining balance is due upon project completion and before the release of the final design files.
Invoicing: Invoices will be issued upon the completion of each project milestone. Payment is due within [5] days of the invoice date. Late payments may incur a fee of [2] % per month.
Cancellation: If the client cancels the project after work has begun, they are responsible for payment of all work completed up to the point of cancellation, including any non-refundable deposits.

5. Delivery and File Formats
​
Final Deliverables: The final design files will be delivered in the agreed-upon formats (e.g., JPEG, PNG, PDF, AI, PSD). Additional formats can be provided upon request and may incur extra charges.
File Storage: The agency will store the final files for 3 months after project completion. It is the client’s responsibility to back up and securely store all received files.

6. Client Responsibilities
​
Timely Feedback: The client agrees to provide timely feedback and approvals throughout the design process. Delays in feedback may affect the project timeline and completion date.
Content and Assets: The client is responsible for providing all necessary content (e.g., text, images, logos) in the required formats. The agency is not liable for any delays caused by the client’s failure to provide these materials.

7. Rejection of Work

Design Rejection: If the client is not satisfied with the initial concepts, the agency will provide [1] additional concepts. If the client is still not satisfied, the project may be terminated, and the client will be billed for all work completed up to that point.
Refund Policy: Refunds are not provided for completed design work. In the case of project cancellation, the client is responsible for paying for all work done up to the cancellation point.

8. Limitation of Liability

No Liability for Client Changes: The agency is not responsible for any changes made to the final design by the client or third parties after the project’s completion.

No Guarantee of Results: The agency does not guarantee any specific results (e.g., increased sales, traffic, or engagement) from the use of the designs provided.

9. Confidentiality and Data Protection
​​​
Confidential Information: Both parties agree to keep all project-related information confidential. The agency will not share the client’s information with third parties without consent.

Data Security: The agency will take reasonable measures to protect the client’s data. However, the agency is not liable for any data breaches caused by external factors beyond its control.
