Fixed Template Website Service

 

Nature of the Service:

 

Our agency offers fixed template websites at an affordable cost. These pre-designed and standardized templates provide a cost-effective solution for customers who need a professional online presence without the expense of a custom-designed website.

The template includes a set layout, design, and content structure that will be the same across multiple customers.

Customization Limitations:

 

Minor customizations such as changing the logo, colour scheme, and text content are allowed within the fixed template structure against service charges.

No structural changes, additional design elements, or significant layout alterations will be made. If extensive customization is required, it will be considered a custom project and subject to additional charges.

 

Content and Images:

 

The content provided within the fixed template, including text and images, is standardized and may be used for multiple clients.

If the client prefers unique content or images, they must provide them. Otherwise, we will use generic content and free-to-use images that comply with copyright laws.

If paid or licensed images are requested, additional charges will apply. If the client is unwilling to pay for these, only free-to-use images will be provided.

Exclusivity:

 

Fixed template websites are not exclusive. The same template and content may be used for multiple clients. By opting for this service, you acknowledge that your website may look similar to others who choose the same template.

Rights and Ownership:

 

The client receives the right to use the website as per the agreed-upon terms. However, the design and structure of the template remain the intellectual property of our agency.

Clients do not have ownership rights to the design template and may not sell, transfer, or distribute it to third parties.

Support and Maintenance:

 

Our agency provides basic support for setting up and launching the fixed template website. Ongoing maintenance or further modifications beyond the initial setup may incur additional fees.





 

Payment and Fees:

 

The cost of the fixed template website is non-negotiable and must be paid in full before the website is launched.

Any additional services, such as content creation, paid images, or custom functionality, will be quoted separately and require client approval before implementation.

Dispute Resolution:

 

Any disputes arising from these terms and conditions will be handled by the applicable laws and regulations.


 

Modification of Terms:

 

These terms and conditions may be updated or modified at any time without prior notice. It is the responsibility of the client to review these terms regularly.



 

 Content for Websites and Social Media

 

Customer Responsibility for Provided Content:

 

Content Submission: Customers may provide text, images, videos, or other media ("Customer Content") for use on their website. By submitting this content, the customer confirms that they have the necessary rights, licenses, or permissions to use and distribute the content.


 

Copyright Compliance: It is the customer's responsibility to ensure that all content provided to us is free from copyright infringement, trademark violations, or any other legal restrictions. The customer guarantees that the content does not violate any third-party rights.

Liability for Copyright Issues:

 

Customer Acknowledgment: By providing content for use on their website or social media, the customer acknowledges that they are solely responsible for the legality of the content. The customer agrees that they will defend, indemnify, and hold our agency harmless from any claims, damages, or legal actions arising from the use of customer-provided content.

Agency’s Limited Liability: Our agency will not be liable for any copyright or legal issues related to the content provided by the customer. This includes any claims made by third parties alleging unauthorized use of their intellectual property.

Documentation and Communication:

 

Written Confirmation: We require written confirmation from the customer (via email, signed documents, or other written forms) whenever content is provided for use. This documentation serves as evidence of the customer's instructions and consent.

Record Keeping: We will maintain records of all communications and submissions related to customer-provided content. These records will be used to resolve any disputes or claims that may arise.


 

Content Review:

 

Optional Content Review: Our agency may offer a content review service to verify the legality of customer-provided content. This service is optional and may incur additional fees. The customer must request this service explicitly if desired.

 

Customer Decision: If the customer declines content review or instructs us to use specific content despite our concerns, they assume full responsibility for any resulting legal issues.


 

Resolution of Disputes:

 

Dispute Handling: In the event of a copyright dispute, our agency will cooperate with the customer to resolve the issue. However, any legal or financial responsibility for resolving such disputes remains with the customer.

Termination and Removal:

 

Content Removal: If a copyright issue arises and is brought to our attention, we reserve the right to remove the infringing content from the website or social media platform immediately. We will notify the customer of the removal and work with them to find a lawful replacement.

Modification of Terms:
